PREMADE BOOK COVER SERVICES
1. The Client is purchasing an “as-is” product. A cover art already being made by HWWO Book Covers (Eleni Tzima).
2. The Client may provide his/her own title, name and/or tagline for this product under the same fonts and design as the premade cover indicates.
3. The Premade covers do not usually allow big changes on their design therefore any other change requests (if possible to be made) they might be subject to a fee.
4. The Premade Covers usually include one review round for textual changes to the design without additional fees. But to the extend that is possible we will try to adjust the cover for the best result possible. Changes requiring a significant amount of work will be considered a Custom Service and subject to the regulation and process of Custom Book Cover Services.
BE AWARE : Premade Covers Sold under Sales or Big events that take place in my group are limited to one review round for textual changes.
CUSTOM BOOK COVER SERVICES
5. The Client is purchasing a design being created in collaboration with the designer. The client may introduce his book's main story and any ideas or special preferences about what the cover might include. As a client you want to make sure that you are familiar with the overall art of Eleni Tzima and the style of her work. The Client will not be purchasing his/her concept developed in detail by the Designer but rather a result as closed as possible to the Client's concept, keeping in mind also any designing details/suggestions which may be in favor of major promotional results.
6. The Custom Covers usually include (3) review rounds without additional fees, but if needed additional changes can be made. Only changes requiring a significant amount of work will come with an additional fee depending on the work.
DESIGNER RESPONSIBILITIES
7. HWWO Book Covers (Eleni Tzima) is responsible to deliver one-of-a-kind cover-art made by her. The cover is sold only once.
8. HWWO Book Covers (Eleni Tzima ) is responsible to use assets that, to her best knowledge and ability, are legally sourced, and it is the creator of work completed.
9. HWWO Book Covers (Eleni Tzima) owes three review rounds during which the client can request changes to the design of the Custom Covers without additional fees.
10. HWWO Book Covers (Eleni Tzima) provides the finished work in JPG, PDF and/or PNG files (if necessary). No PSD files are included with any purchase, due to copyright reasons and licensing restrictions on the resources that have been used.
11. HWWO Book Covers (Eleni Tzima ) owes to keep all client information and materials confidential . Client information and project materials will not be given out or shared with any third party, unless otherwise requested by the client.
12. HWWO Book Covers (Eleni Tzima) is responsible to notify and keep the client informed for any additional licences ( stock images, materials, fonts ) that need to be purchased, providing him/her with the related info and links/sites where the licences need to be purchased from.
CLIENT RESPONSIBILITIES
13. The Client is responsible for proofing the book cover design provided by HWWO Book Covers (Eleni Tzima). The client is responsible to request a proof from the printer before ordering any materials using the book cover design. At no time will HWWO Book Covers (Eleni Tzima) be held financially or legally responsible for any problems, costs, fees or expenses incurred by client as a result of using the book cover design.
14. If the client supplies HWWO Book Covers (Eleni Tzima ) with materials subject to intellectual property rights by a third-party, the client will secure the appropriate rights to use the materials before directing HWWO Book Covers (Eleni Tzima) to incorporate them into his/her project. Should any intellectual property dispute arise involving materials the client provides, the client assumes full legal and financial responsibility. Client agrees to indemnify, hold harmless and defend HWWO Book Covers (Eleni Tzima) from any and all libel copyright and permission infringement action resulting from materials client provides. The book material client provides must not be a public domain work (unless the client is the original author).
15. The Client agrees to pay upfront 50% of the total price for a Custom Cover/Package before work will begin on the project. HWWO Book Covers (Eleni Tzima) will not release finished files to the client or other parties until the total amount has been received. HWWO Book Covers (Eleni Tzima) retains the right to discontinue, withhold, or suspend services for any account should payments not be paid for a contracted job as specified in this agreement.
16. The client agrees to abide by the terms of any license agreement for any images or fonts purchased by HWWO Book Covers (Eleni Tzima )through a third-party image provider for use in client’s book cover design. The cost of cover design includes the license to use these images and is limited to a print run of 250,000 units sometimes might be less. For prints that run over 250,000, additional licensing fees may apply. The Client is then solely responsible to purchase the extended Licence for any of these images or Fonts. Images used for client’s cover are royalty-free; however, the photographer owns the copyright to those photographs and they cannot be distributed in any manner other than in the book cover design.
17. The client is purchasing a premade or a custom cover responsibly in relation to any resemblance with any famous copyrighted work. The designer (Eleni Tzima) is not responsible for any resemblance with any copyrighted work in relation to client's given info such as Book Title, tagline, pen name, in combination with the book cover's artwork.At no time will HWWO Book Covers (Eleni Tzima) be held financially or legally responsible for any problems, costs, fees or expenses incurred by client as a result of using the book cover design.
OWNERSHIP RIGHTS
18. Upon receipt of full payment, HWWO Book Covers (Eleni Tzima ) grants the client exclusive license to use the final cover design artwork (PDF, JPEG or other publishing-ready format) for his/her book cover and associated promotional materials.
19. The client understands that he/she has no right to alter the final cover design in any way except to change size for printing or digital display, unless HWWO Book Covers (Eleni Tzima) is suggesting otherwise. If the client desires any alterations, he/she will consult HWWO Book Covers (Eleni Tzima ). The client understands that additional payments may be required to make these alterations.
20. HWWO Book Covers (Eleni Tzima ) retains the right to use client’s final and draft book cover design, name, and book title in HWWO Book Covers (Eleni Tzima ) portfolio and to market and promote their services. Author has priority if she/he wants to wait for the cover to be revealed.
21. HWWO Book Covers (Eleni Tzima ) retains copyright and ownership of all design and draft materials.
CANCELLATION POLICY
21. For custom covers, the client or HWWO Book Covers (Eleni Tzima) may cancel this agreement at any time within (10) days from the day this contract is been signed, by providing written/e-mail notice to the other party. A refund is possible when HWWO Book Covers (Eleni Tzima) has not yet started working on the project. When already started, refunds are not possible anymore. The Client will be notified when HWWO Book Covers (Eleni Tzima) has started working with his/her project.
22. For premade covers, all purchases are non-refundable.
HWWO Book Covers (Eleni Tzima) is allowed to display the work in her portfolio/website and personal/professional media accounts or as a printed work for promotional purposes.
